Attendee Terms and Conditions

By purchasing, accessing, transferring, or attending the Build Business Better Conference (the "Conference"), you agree to these Terms and Conditions in full. If you do not agree to these Terms, do not purchase or attend the Conference.

1. About the Conference

The Build Business Better Conference is a paid virtual event hosted by Swan Town Creative, LLC d/b/a Swan Town Creative Systems ("Swan Town Creative," "we," "us," or "our"). The Conference is conducted online through platforms including, but not limited to, HeySummit, Zoom, Slack, and StreamYard.

Swan Town Creative reserves the right to modify, substitute, remove, or change platforms, technology providers, delivery methods, or communication tools at any time as needed for operational, technical, accessibility, or business purposes.

Certain premium experiences, including but not limited to the Deep Dive Lab and Kit & Caboodle All Access Pass, are subject to additional supplemental terms and participation requirements. Purchase or participation in these experiences constitutes acceptance of any applicable supplemental terms. In the event of a conflict between these Terms and any applicable supplemental terms, the supplemental terms shall control with respect to the applicable premium experience.

The Deep Dive Lab is subject to the Deep Dive Lab Supplemental Terms. The Kit & Caboodle All Access Pass is subject to the Kit & Caboodle Supplemental Terms.

2. Ticket Purchase and Payment

2a. All Sales Are Final

All ticket sales are final. Swan Town Creative does not offer refunds or exchanges for any ticket tier, including but not limited to schedule conflicts, attendee technical difficulties, speaker lineup changes, inability to attend live, dissatisfaction with event content, personal emergencies, travel issues, or timezone conflicts.

By purchasing a ticket, you acknowledge and agree that no refunds or charge reversals will be provided except where expressly required by applicable law.

2b. Pricing and Automatic Increases

Ticket prices are subject to automatic increases at predetermined intervals without prior individual notice. Swan Town Creative reserves the right, at any time, to modify pricing, discontinue pricing tiers, add or remove bonuses, or change promotional offers.

2c. Founding Inner Circle Pass

The Founding Inner Circle Pass is invitation-only, limited in quantity, non-transferable, and not eligible for affiliate commissions. This ticket tier includes additional experiences and benefits not included in standard admission tiers. Swan Town Creative reserves the right to modify or discontinue availability of this tier at any time.

2d. Community Insider Pass

The Community Insider Pass is a discounted ticket tier offered through select partner communities, organizations, affiliates, or referral relationships designated by Swan Town Creative. Community Insider Pass holders receive the same Conference access and attendee rights associated with the applicable standard admission tier unless otherwise specified. Swan Town Creative reserves the right to modify, discontinue, or limit availability of this ticket tier at any time.

2e. Bring Your Business Besties Pass

The Bring Your Business Besties Pass includes admission for multiple attendees as described at the time of purchase. The purchaser is responsible for providing accurate registration information for all included attendees within any deadlines communicated by Swan Town Creative. Unused admissions have no cash value and may not be redeemed for refunds, credits, or substitutions.

2f. Kit & Caboodle All Access Pass

The Kit & Caboodle All Access Pass includes Conference admission, Deep Dive Lab access, one (1) additional Build Better Pass ticket for a guest, and one (1) seventy-five (75) minute one-on-one session with Swan Town Creative, as further described in the Kit & Caboodle All Access Pass Supplemental Terms.

The purchaser is responsible for providing any required guest information within any deadlines communicated by Swan Town Creative.

The one-on-one session must be scheduled and completed within the timeframe specified in the Kit & Caboodle All Access Pass Supplemental Terms.

Unused benefits, guest tickets, one-on-one sessions, Deep Dive Lab access, recordings, or other included components have no cash value and may not be redeemed for refunds, credits, substitutions, extensions, or cash payments.

Participation in the Kit & Caboodle All Access Pass is subject to the Kit & Caboodle All Access Pass Supplemental Terms in addition to these Terms and Conditions.

2g. Transaction Processing

Transactions may be processed through HeySummit, Stripe, PayPal, StudioCart, or other designated payment processors. By completing your purchase, you also agree to the applicable third-party payment processor terms and conditions. Swan Town Creative is not responsible for technical issues, outages, payment processor interruptions, banking delays, or transaction errors originating outside of Swan Town Creative's direct control.

2h. Chargebacks and Payment Disputes

By purchasing a ticket, you agree to contact Swan Town Creative at events@swantowncreative.com prior to initiating any chargeback or payment dispute.

Initiating a fraudulent or bad-faith chargeback may result in immediate revocation of Conference access, removal from community spaces, loss of replay access, and ineligibility for future Swan Town Creative events or services. Swan Town Creative reserves all rights to pursue collection or legal remedies related to fraudulent chargebacks.

3. Ticket Transfers

Ticket transfers are permitted for eligible ticket tiers by 5 PM ET up to three (3) business days prior to the start of the Conference. Transfer requests must be submitted via email to events@swantowncreative.com with the subject line or body including "Request for Ticket Transfer."

The original purchaser must provide their full name, the email address used during registration, the full name of the new attendee, and the email address of the new attendee.

Ticket transfers are subject to approval, not guaranteed, limited to one transfer per ticket, and prohibited for resale purposes. The original purchaser remains financially responsible for the original purchase, including any chargebacks, disputes, or fraudulent activity associated with the transaction. Any transferred attendee must agree to the current Terms and Conditions and Privacy Policy prior to receiving access.

The Founding Inner Circle Pass is non-transferable.

3a. Multi-Attendee Ticket Purchases

Certain ticket tiers may include admission for more than one attendee. For tickets that include admission for multiple attendees, the purchaser represents that they have authority to provide attendee information and agrees to communicate these Terms and Conditions and Privacy Policy to any additional attendees. All attendees who access the Conference are deemed to have accepted these Terms and Conditions and Privacy Policy through their participation.

The purchaser is responsible for providing any additional attendee information requested by Swan Town Creative within any deadlines communicated by the Conference organizer. Failure to provide required attendee information may result in forfeiture of unused admissions without refund.

4. What Your Ticket Includes

Unless otherwise specified at the time of purchase, all paid ticket tiers include live virtual access to Conference sessions, limited-time replay access, session transcripts, official Conference workbook, and access to designated Conference community spaces.

Replay access is provided as a courtesy and is not guaranteed indefinitely. Swan Town Creative reserves the right to modify, restrict, suspend, or remove replay access at any time.

Complimentary ticket holders receive the same access rights associated with the corresponding ticket tier unless otherwise specified in writing.

Premium ticket tiers, including the Kit & Caboodle All Access Pass and Deep Dive Lab, may include additional deliverables, resources, coaching experiences, implementation sessions, templates, bonuses, or community access as described at the time of purchase. Certain ticket tiers may include admission for multiple attendees, merchandise, promotional items, or additional benefits as described at the time of purchase.

4a. Physical Merchandise and Shipping

Certain ticket tiers, promotions, or Conference offers may include physical merchandise, gifts, or promotional items. Attendees are responsible for providing accurate shipping information. Swan Town Creative is not responsible for incorrect shipping information provided by attendees.

Conference merchandise may be fulfilled through third-party print-on-demand providers. Swan Town Creative is not responsible for delays, fulfillment errors, manufacturing defects, customs issues, carrier delays, lost shipments, or other issues arising from third-party fulfillment providers or shipping carriers. Shipping timelines are estimates only and are not guaranteed.

Merchandise and promotional items have no cash value and may not be exchanged for refunds, credits, substitutions, or cash equivalents unless required by applicable law. Swan Town Creative reserves the right to substitute merchandise, colors, sizes, designs, fulfillment providers, or promotional items of comparable value where reasonably necessary.

5. Access, Attendance, and Technology Requirements

Conference access is tied to the email address used at registration. Attendees are responsible for maintaining accurate registration information, securing login credentials, maintaining compatible devices, and ensuring adequate internet access. Account sharing is prohibited.

Swan Town Creative reserves the right to revoke access without refund for unauthorized account sharing, suspected abuse, unauthorized redistribution, fraudulent activity, or violations of these Terms.

Swan Town Creative is not responsible for attendee-side technical issues including but not limited to internet outages, browser incompatibility, software issues, hardware failure, device incompatibility, or audio or video interruptions. No refunds or credits will be issued for attendee-side technical difficulties.

6. Community Access and Conduct

Conference participation may include access to Slack communities, breakout rooms, networking sessions, live chats, implementation sessions, and community discussion spaces. These spaces are considered semi-public environments. Attendees are encouraged to exercise respectful discretion when sharing sensitive information. Swan Town Creative does not guarantee confidentiality for attendee discussions, community participation, or breakout room conversations.

Community access duration and availability are determined solely by Swan Town Creative and may be modified, suspended, or discontinued at any time without notice. Community access is provided as a courtesy and is not guaranteed for any specific duration.

Attendees agree to refrain from harassment, hate speech, discrimination, disruptive conduct, spam or solicitation, unauthorized promotion, abusive behavior, unauthorized recording, sharing confidential attendee information, or behavior inconsistent with the Conference experience.

Swan Town Creative reserves the right to remove attendees from community spaces, revoke live session access, revoke replay access, remove attendees from breakout rooms, or prohibit future participation in Swan Town Creative events or programs without refund or warning if conduct is deemed disruptive, unsafe, inappropriate, harmful, or inconsistent with the Conference environment.

7. Speaker and Agenda Changes

Swan Town Creative reserves the right to modify session schedules, session lengths, presentation formats, speakers, panelists, event structure, community activities, and networking experiences at any time without prior notice. Speaker cancellations or substitutions do not entitle attendees to refunds, credits, or compensation of any kind.

8. Event Postponement, Cancellation, and Force Majeure

If the Conference is postponed due to circumstances outside Swan Town Creative's reasonable control, tickets will automatically transfer to the rescheduled date. If Swan Town Creative determines the Conference cannot reasonably be rescheduled, Swan Town Creative may provide either a refund, event credit, replay access, or substitute programming, at its sole discretion.

Circumstances may include, but are not limited to, internet outages, cyberattacks, platform failures, software outages, power failures, natural disasters, governmental restrictions, illness, emergencies, labor disruptions, acts of God, speaker emergencies, or technical interruptions.

This section represents the sole remedy available related to postponement, cancellation, or force majeure events.

9. Recording, Media Release, and Content Usage

Conference sessions may be recorded. By participating in the Conference, including through video, audio, chat, breakout rooms, worksheets, implementation exercises, community participation, testimonials, feedback, submitted questions, or comments, you grant Swan Town Creative the right to use, reproduce, modify, publish, distribute, display, and share such materials for marketing, educational, promotional, commercial, and archival purposes without additional approval, compensation, or notice.

Attendees may engage in reasonable social sharing, including posting screenshots, quoting speakers, sharing insights, tagging speakers, and posting attendee experiences, provided such sharing does not include full recordings, substantial portions of paid content, downloadable resources, transcripts, workbook materials, or unauthorized redistribution of Conference materials.

10. Intellectual Property and License Restrictions

All Conference materials, including but not limited to recordings, transcripts, slides, templates, workbooks, branding, worksheets, implementation materials, downloadable resources, and session content, are protected intellectual property owned by Swan Town Creative and/or the respective speakers. Speakers retain ownership of their individual presentation materials and content.

Your ticket purchase grants you a limited, revocable, non-exclusive, non-transferable license for personal, non-commercial use only. You may not reproduce, redistribute, resell, sublicense, commercially exploit, republish, upload, publicly share, modify, or create derivative works from Conference materials without written permission.

Conference materials may not be used to train AI systems, datasets, machine learning tools, or derivative commercial technologies. Unauthorized use may result in revoked access and legal action.

11. AI-Generated Materials Disclaimer

Certain Conference materials, including transcripts, summaries, captions, and post-event resources, may be generated or assisted through artificial intelligence tools. AI-generated materials may contain inaccuracies, omissions, formatting issues, or transcription errors. Attendees are responsible for independently verifying any information before relying on it for business, legal, financial, operational, or professional decisions.

12. Accessibility Accommodations

Swan Town Creative is committed to making reasonable efforts to support accessibility needs for Conference attendees. Requests for accommodations should be submitted no later than October 16, 2026 by contacting events@swantowncreative.com.

Closed captioning and transcripts will be made available, though automated systems may contain inaccuracies or delays.

13. Privacy and Marketing Communications

By registering for the Conference, you consent to receive event-related communications, operational updates, replay notifications, marketing communications, and promotional emails from Swan Town Creative.

You may unsubscribe from marketing communications at any time, though operational event communications may still be sent as necessary. Unsubscribing from marketing communications may limit your ability to receive certain Conference-related updates, reminders, replay notifications, or other event information.

Your registration information, participation in the Conference, and use of Conference platforms are governed by the Build Business Better Conference Privacy Policy. To the extent applicable, Swan Town Creative's general website Privacy Policy may also apply to your use of Swan Town Creative websites and services.

14. Disclaimer of Warranties and Professional Advice

The Conference and all associated materials are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.

Conference content is provided for educational and informational purposes only and does not constitute legal, accounting, tax, financial, medical, mental health, or therapeutic advice or services.

Attendance at or participation in the Conference does not guarantee revenue increases, business growth, operational outcomes, audience growth, financial results, client acquisition, or implementation success. Your results depend on your own circumstances, decisions, effort, market conditions, and implementation.

15. Limitation of Liability

To the maximum extent permitted by law, Swan Town Creative's total liability arising out of or related to the Conference shall not exceed the total amount paid by you for your ticket.

Swan Town Creative shall not be liable for any indirect, incidental, consequential, or special damages, lost profits, business interruption, loss of data, reputational harm, or punitive damages arising from Conference participation or inability to participate.

16. Severability

If any provision of these Terms and Conditions is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

17. Waiver

Failure by Swan Town Creative to enforce any provision of these Terms and Conditions shall not constitute a waiver of future enforcement of that provision or any other provision.

18. Governing Law

This Agreement shall be governed by the laws of the State of Georgia. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the state or federal courts located in Cobb County, Georgia.

19. Amendments

Swan Town Creative reserves the right to modify or update these Terms and Conditions at any time. Updated Terms will be posted at buildbusinessbetterconference.com/terms-conditions. Continued participation in the Conference after updates constitutes acceptance of the revised Terms. Material changes may be communicated to registered attendees via email.

21. Entire Agreement

These Terms and Conditions, together with the applicable Privacy Policy and any supplemental terms expressly referenced herein, constitute the entire agreement between you and Swan Town Creative regarding Conference participation.

Swan Town Creative takes your privacy seriously. This Privacy Policy explains what information we collect when you register for or attend the Build Business Better Conference, how we use it, who we share it with, and what your rights are. If you have questions, reach us at events@swantowncreative.com.

1. Who This Policy Covers

This policy applies to all individuals who interact with the Build Business Better Conference, including waitlist subscribers, podcast subscribers, ticket purchasers, attendees, and anyone who submits information through buildbusinessbetterconference.com or associated registration and checkout forms.

2. What We Collect and When

2a. When You Join the Waitlist or Subscribe to the Seen On Purpose Podcast

We collect your name and email address. This is used to communicate early access opportunities, conference updates, and relevant Swan Town Creative content. Subscribing constitutes consent to receive email communications related to the Conference and Swan Town Creative's offerings.

2b. When You Register for a Ticket

We collect the following information through the HeySummit registration and checkout process:

  • Full name
  • Email address
  • Business name and/or role (if requested in registration questions)
  • Shipping address (for attendees who purchase merchandise, merchandise-inclusive ticket tiers, promotional items, giveaways, or other physical products)
  • Any information you provide in response to the 2–4 registration questions included at checkout
  • Payment information (processed directly by third-party payment providers and platforms used by Swan Town Creative. We do not store your payment card data)

If you register through an affiliate link, that affiliate relationship is tracked by HeySummit. The affiliate receives a commission from Swan Town Creative directly. This does not affect your ticket price.

2c. When You Attend the Conference

If you participate in sessions via video or audio, your name or likeness may be captured in session recordings. Chat participation in sessions or the Slack community may also be captured or logged. We do not actively monitor or record private direct messages.

2d. From Third-Party Tools

We may receive usage data and analytics from the platforms we use to deliver the Conference, including information about how you interact with emails, the conference platform, or community tools.

3. How We Use Your Information

We use the information we collect to:

  • Process your ticket purchase and confirm your registration
  • Deliver access credentials and conference materials
  • Send pre-event, during-event, and post-event email communications via Kit (ConvertKit) and/or HelloAudio.fm
  • Segment and tag your registration by ticket tier to send you relevant, tier-appropriate communications
  • Send operational updates, schedule changes, or speaker announcements
  • Follow up after the Conference with relevant Swan Town Creative offerings (you can opt out at any time)
  • Improve future events based on aggregate, anonymized data

Purchasing a ticket opts you into Conference-related email communications. You can manage your email preferences or unsubscribe at any time using the link in any email we send. Unsubscribing from marketing emails does not affect your ability to receive transactional communications related to your ticket.

4. Third-Party Platforms and Processors

We use the following third-party tools to operate the Conference. Each has its own privacy policy governing how it handles your data:

  • HeySummit — conference registration, ticketing, affiliate tracking, and session delivery platform
  • Kit (ConvertKit) — email marketing and audience segmentation
  • SureCart — payment processing for select post-conference transactions
  • StudioCart — payment processing for select post-conference transactions
  • Stripe — payment processing for select conference transactions
  • PayPal — payment processing for select conference transactions
  • Zoom — live session delivery for select sessions
  • StreamYard — live production for select sessions
  • Vimeo — post-conference replay hosting
  • Slack — Conference community access
  • Google Analytics — website traffic and behavior analytics
  • Meta/Facebook — website retargeting and advertising
  • Merchandise fulfillment providers and shipping partners — production, packaging, fulfillment, and delivery of Conference merchandise and physical items

We do not sell your personal information to any third party. We share data with the platforms above only as necessary to operate the Conference and deliver the services you have registered for.

5. Email Communications

By registering for the Conference, you consent to receive email communications from Swan Town Creative related to the event. These include pre-event logistics and preparation emails, session-day communications, post-event follow-up, and relevant offers from Swan Town Creative following the Conference.

You can unsubscribe from non-transactional emails at any time. If you unsubscribe from all Swan Town Creative communications before the Conference, you may miss time-sensitive event information. We recommend managing your preferences rather than unsubscribing entirely until after the event.

6. Cookies and Tracking

The buildbusinessbetterconference.com website uses cookies and similar technologies to understand how visitors interact with the site and to support retargeting for advertising purposes. Cookies are small files placed on your device by the site. You can configure your browser to limit or block cookies, though some site features may not function correctly without them.

Tracking technologies active on the site may include those associated with Google Analytics, Meta/Facebook, and other advertising platforms. These tools may collect your IP address, browser type, pages visited, and referral information.

Where required by applicable law, visitors may be presented with a cookie consent banner allowing them to manage certain tracking preferences.

Certain referral and affiliate tracking technologies may be used to identify the source of a visitor's registration or purchase and to facilitate affiliate commission calculations. These technologies may remain active as reasonably necessary to support affiliate attribution, fraud prevention, transaction processing, and related operational functions. Affiliate tracking does not increase the price paid by attendees and is used solely for internal attribution and program administration purposes.

7. Data Retention

We retain registrant information for as long as necessary to operate the Conference, fulfill our obligations to you, and comply with applicable legal requirements. Following the conclusion of the Conference, your information will be retained in our email platform unless you request removal. Recordings and transcripts are retained at Swan Town Creative's discretion.

To request deletion of your data, contact us at events@swantowncreative.com. We will process requests within a reasonable timeframe, subject to any legal obligations that require us to retain certain records.

8. Your Rights

Depending on your location, you may have the following rights regarding your personal information:

  • The right to access the personal data we hold about you
  • The right to request correction of inaccurate data
  • The right to request deletion of your data (subject to legal retention requirements)
  • The right to withdraw consent for marketing communications at any time
  • The right to data portability (where applicable)

The Build Business Better Conference is intended for adults 18 years of age and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has submitted information to us, contact us immediately at events@swantowncreative.com.

We store and transmit your personal information using industry-standard security practices and rely on third-party platforms that maintain their own security programs. No method of transmission over the internet is completely secure, and we cannot guarantee absolute security. We take reasonable steps to protect your information and will notify you in the event of a breach that affects your data, as required by applicable law.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Updated versions will be posted at buildbusinessbetterconference.com/privacy-policy with the effective date noted at the top. Continued use of your Conference registration following any update constitutes acceptance of the revised policy. For material changes, we will make reasonable efforts to notify registered attendees via email.

Deep Dive Lab Supplemental Terms

These Deep Dive Lab Supplemental Terms ("Supplemental Terms") apply to all participants who purchase, receive, or attend the Deep Dive Lab offered in connection with the Build Business Better Conference.

These Supplemental Terms are incorporated into and governed by the Build Business Better Conference Terms and Conditions and Privacy Policy. In the event of a conflict between these Supplemental Terms and the Conference Terms and Conditions, these Supplemental Terms shall govern solely with respect to the Deep Dive Lab experience.

By purchasing, accessing, or participating in the Deep Dive Lab, you agree to these Supplemental Terms.

1. What the Deep Dive Lab Includes

The Deep Dive Lab is a small-group implementation and strategy experience designed to help participants apply concepts, insights, and ideas from the Build Business Better Conference. Swan Town Creative reserves the right to modify participant capacity, facilitator assignments, breakout room structure, agenda, timing, or session format as reasonably necessary.

The Deep Dive Lab may include:

  • Implementation discussions
  • Strategy exercises
  • Group feedback
  • Participant questions
  • Breakout room conversations
  • Peer discussion
  • Live coaching-style facilitation
  • Recommendations and action planning

2. Participation Expectations

Participants are expected to engage respectfully, contribute constructively, maintain professional conduct, avoid disrupting discussions, and respect the participation of others.

Participation is voluntary. Participants are encouraged to share only information they are comfortable discussing in a group setting.

3. Sharing Business Information

Participants may choose to discuss business operations, systems, hiring, team structures, offers, marketing, finances, client experiences, and strategic challenges.

Participants are encouraged to respect the privacy of others and exercise discretion regarding information shared during the Deep Dive Lab.

The Deep Dive Lab is not a confidential environment. Swan Town Creative cannot guarantee that information shared by participants will remain private and is not responsible for information voluntarily disclosed during discussions, breakout rooms, chats, or networking activities.

4. Recordings and Participation

The Deep Dive Lab may be recorded in whole or in part. By participating, you acknowledge that your name, image, voice, comments, questions, chat messages, and participation may appear in recordings, transcripts, summaries, notes, or related materials.

Recordings may be made available to other eligible participants, included in future educational resources, or otherwise used in accordance with the Build Business Better Conference Terms and Conditions and Privacy Policy.

Participants who do not wish to appear on camera may choose to keep their camera off, though verbal participation, chat participation, and submitted questions may still be captured.

5. Feedback and Recommendations

Participants may receive feedback, recommendations, observations, implementation suggestions, and strategic guidance. All feedback is provided for educational and informational purposes only.

Participants remain solely responsible for any decisions they make and any actions they take based on feedback, recommendations, observations, implementation suggestions, or strategic guidance provided during the Deep Dive Lab. Swan Town Creative makes no guarantees regarding outcomes, results, revenue, profitability, business growth, implementation success, or operational improvements.

6. Community Standards and Removal

Swan Town Creative reserves the right to remove any participant from the Deep Dive Lab without refund if their behavior is deemed disruptive, abusive, harassing, discriminatory, unsafe, inappropriate, or detrimental to the participant experience.

Removal from the Deep Dive Lab may also result in removal from associated community spaces, recordings, future participation opportunities, or other Conference-related experiences at Swan Town Creative's discretion without refund.

7. Room To Build Promotional Credit

The Deep Dive Lab includes one (1) promotional credit in the amount of one hundred dollars ($100 USD) that may be applied toward enrollment in the Room To Build group program offered by Swan Town Creative.

The promotional credit:

  • has no cash value
  • is non-transferable
  • may not be assigned or sold
  • may not be redeemed for cash or credit
  • may only be used by the original Deep Dive Lab participant
  • may only be applied toward the Room To Build group program
  • may not be combined with other promotional offers unless expressly authorized by Swan Town Creative

Swan Town Creative will provide the applicable promotional code and redemption instructions directly to eligible participants.

The promotional credit must be redeemed on or before December 1, 2026, unless otherwise communicated by Swan Town Creative. Unused promotional credits expire automatically and have no cash value.

The promotional credit does not guarantee admission to the Room To Build group program. Enrollment remains subject to availability and any eligibility requirements established by Swan Town Creative.

8. Intellectual Property

Participants receive access to Deep Dive Lab materials for personal, non-commercial use only.

Participants may not record sessions, redistribute recordings, share proprietary materials, reproduce worksheets or resources for commercial purposes, republish participant materials, or create derivative commercial products from Deep Dive Lab content.

All intellectual property rights remain with Swan Town Creative and applicable contributors. Participants may not upload, submit, distribute, or use Deep Dive Lab recordings, materials, discussions, participant contributions, or related content to train, improve, analyze, summarize, reproduce, generate content with, or otherwise support artificial intelligence systems, machine learning models, datasets, or derivative commercial technologies without prior written permission from Swan Town Creative.

9. No Professional Relationship Created

Participation in the Deep Dive Lab does not create a consulting relationship, a coaching agreement, an employment relationship, a partnership, or a fiduciary relationship.

Participation in the Deep Dive Lab does not guarantee ongoing access to Swan Town Creative beyond the scope of the experience purchased.

10. Limitation of Liability

To the maximum extent permitted by law, Swan Town Creative's total liability arising from or relating to the Deep Dive Lab shall not exceed the amount paid by the participant for access to the Deep Dive Lab.

Swan Town Creative shall not be liable for any indirect, incidental, consequential, special, punitive, or lost-profit damages arising from participation in the Deep Dive Lab.

11. Unused Benefits

Failure to use any portion of the Deep Dive Lab, including but not limited to live sessions, recordings, promotional credits, or other included benefits, does not entitle the participant to a refund, credit, extension, transfer, substitution, or cash payment.

12. Relationship to Conference Terms

All provisions of the Build Business Better Conference Terms and Conditions and Privacy Policy remain in full force and effect. Participation in the Deep Dive Lab constitutes acceptance of the Conference Terms and Conditions, the Conference Privacy Policy, and these Deep Dive Lab Supplemental Terms.

Swan Town Creative reserves the right to update these Supplemental Terms from time to time, with updated versions posted on the Conference legal page.

13. Severability

If any provision of these Supplemental Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

These Kit & Caboodle All Access Pass Supplemental Terms ("Supplemental Terms") apply to all participants who purchase, receive, or access the Kit & Caboodle All Access Pass offered in connection with the Build Business Better Conference.

These Supplemental Terms are incorporated into and governed by the Build Business Better Conference Terms and Conditions, Privacy Policy, and, where applicable, the Deep Dive Lab Supplemental Terms. In the event of a conflict between these Supplemental Terms and the Conference Terms and Conditions, these Supplemental Terms shall govern solely with respect to the Kit & Caboodle All Access Pass.

By purchasing, accessing, or participating in the Kit & Caboodle All Access Pass, you agree to these Supplemental Terms.

1. What the Kit & Caboodle All Access Pass Includes

The Kit & Caboodle All Access Pass is a premium Conference package that includes:

  • one (1) Build Better Pass
  • one (1) Deep Dive Lab registration
  • one (1) additional Build Better Pass ticket for a guest designated by the participant
  • one (1) seventy-five (75) minute one-on-one session with Swan Town Creative
  • one (1) non-transferable promotional credit of two hundred fifty dollars ($250 USD) toward enrollment in the Room To Build group program, subject to any additional terms communicated by Swan Town Creative
  • Conference merchandise for participants who provide a valid United States shipping address
  • additional Conference merchandise for an eligible guest receiving the included Build Better Pass, provided the guest information is submitted in accordance with these Supplemental Terms

Specific features, delivery methods, scheduling procedures, implementation details, promotional credits, and merchandise offerings may be modified by Swan Town Creative as reasonably necessary to operate the Conference and related experiences.

2. One-on-One Session

The Kit & Caboodle All Access Pass includes one (1) seventy-five (75) minute one-on-one session with Swan Town Creative.

The session may include consulting discussions, strategy, implementation support, business operations discussions, planning, feedback, recommendations, or other topics deemed appropriate by Swan Town Creative and the participant.

Sessions will be conducted via Zoom or another platform designated by Swan Town Creative.

Sessions may be recorded. Swan Town Creative intends to provide participants with a recording of the session; however, recording availability is not guaranteed and Swan Town Creative shall not be liable for technical failures, recording errors, platform outages, or other circumstances that prevent delivery of a recording.

The session is intended to provide strategic discussion, feedback, recommendations, and implementation support. The participant retains sole responsibility for all business, financial, legal, operational, and personnel decisions.

The one-on-one session is personal to the participant and may not be transferred, assigned, gifted, sold, or exchanged to another individual.

3. One-on-One Session Discussions and Confidentiality

During the one-on-one session, participants may choose to discuss topics including, but not limited to:

  • business operations
  • systems
  • hiring
  • team structures
  • offers
  • marketing
  • finances
  • client experiences
  • strategic challenges

Swan Town Creative will make reasonable efforts to maintain the privacy of information voluntarily shared during the one-on-one session and will not intentionally disclose such information except as required by law, to operate the session, or as otherwise authorized by the participant.

Participants should not assume that discussions are protected by attorney-client privilege, fiduciary privilege, or any other legally recognized confidentiality relationship.

Participants remain responsible for determining what information they choose to disclose during the session.

4. Educational and Informational Disclaimer

The one-on-one session is provided for educational, informational, strategic, and business discussion purposes only.

Swan Town Creative is not acting as the participant's attorney, accountant, financial advisor, investment advisor, tax professional, licensed mental health professional, or other regulated professional advisor.

Any information, feedback, recommendations, observations, implementation suggestions, or strategic guidance provided during the session is intended solely to assist the participant in evaluating potential business decisions.

Participants remain solely responsible for obtaining appropriate legal, accounting, tax, financial, employment, insurance, compliance, or other professional advice from qualified professionals regarding their specific circumstances.

Participants remain solely responsible for all decisions, actions, implementation efforts, and business outcomes resulting from their participation in the session.

Swan Town Creative makes no guarantees regarding results, revenue, profitability, business growth, operational improvements, client acquisition, implementation success, or any other outcome.

5. Scheduling, Rescheduling, and Expiration

The one-on-one session must be scheduled and completed on or before December 31, 2026.

Unused sessions expire after December 31, 2026 and are forfeited without refund, credit, extension, or cash value.

Participants may reschedule with at least twenty-four (24) hours notice.

Failure to provide at least twenty-four (24) hours notice may result in forfeiture of the session.

If a participant fails to attend a scheduled session, the session may be forfeited.

Swan Town Creative may, but is not obligated to, grant exceptions on a case-by-case basis.

If Swan Town Creative must cancel or reschedule a session due to illness, emergency, travel, scheduling conflicts, or other circumstances, Swan Town Creative will make reasonable efforts to provide notice and reschedule the session.

6. Guest Ticket

The Kit & Caboodle All Access Pass includes one (1) additional Build Better Pass ticket for a guest designated by the participant.

The participant is responsible for providing accurate guest information.

If Conference merchandise is included as part of the Kit & Caboodle All Access Pass, merchandise for the participant's guest will be provided only after Swan Town Creative receives the guest's required registration information.

Participants should provide guest information no later than October 20, 2026. Guest information submitted after that date may result in delayed processing, delayed access, missed communications, or inability to participate in portions of the Conference.

Guest tickets:

  • have no cash value
  • may not be redeemed for credit
  • may not be exchanged for alternative benefits
  • may not be carried forward to future events

Swan Town Creative reserves the right to establish reasonable administrative procedures for assigning and issuing guest tickets.

Guest tickets may not be transferred, reassigned, sold, or substituted after they have been issued unless Swan Town Creative approves the change in writing.

7. Room To Build Promotional Credit

The Kit & Caboodle All Access Pass includes one (1) promotional credit in the amount of two hundred fifty dollars ($250 USD) that may be applied toward enrollment in the Room To Build group program offered by Swan Town Creative.

Swan Town Creative makes no guarantee regarding:

  • business results
  • implementation success
  • revenue growth
  • profitability
  • lead generation
  • operational improvements
  • client acquisition
  • business outcomes of any kind

Participants remain solely responsible for all decisions, actions, implementation efforts, and business outcomes.
